Terms of Service

By accessing or playing Fractara ("the Game"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Game. We reserve the right to modify these terms at any time, and your continued use of the Game constitutes acceptance of any changes.

You must be at least 13 years old to play Fractara. By using the Game, you represent and warrant that you meet this age requirement. If you are under 18, or under the age of majority where you live, you represent that you have your parent or guardian's permission to use the Game.

When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Not share your account with others

When playing Fractara, you agree NOT to:

• Use cheats, exploits, automation software, bots, or hacks
• Spoof or manipulate your location data
• Use alternate or multiple accounts to farm rewards, gain an unfair advantage, or evade bans, suspensions, or other account restrictions
• Harass or abuse other players, make real-world threats, share private personal information, or evade communication blocks
• Use hateful or sexually harassing usernames or messages, or engage in sustained personal abuse
• Impersonate other players or staff members
• Attempt to gain unauthorized access to the Game or other accounts
• Interfere with or disrupt the Game servers or networks
• Buy, sell, or trade accounts, characters, Old World Coins, gold, or other in-game items for real money or anything else of value outside the Game (unless officially supported)
• Engage in any activity that violates applicable laws

Fractara is a competitive war game. Raids, retaliation, territory destruction, bounties, competition for rewards, and competitive banter are expected when permitted by the game’s rules. Repeated attacks or a long-running feud do not, by themselves, establish harassment. In-game threats against territory are distinct from real-world threats.

Real-world threats, sharing someone’s private information, hate speech, sexual harassment, and sustained personal abuse are prohibited. Competitive banter can cross that line; calling something a joke does not excuse it. Stop private messages when someone asks you to stop. Do not bypass blocks or use other people to continue unwanted contact. Ending a conversation does not require ending permitted in-game competition.

Use Block or the profanity filter to control what you see, and report specific messages when you believe a rule was broken. You do not have to block someone before reporting abuse. Filing a report does not grant protection from ordinary gameplay, and a report is not proof of wrongdoing.

We consider the actual messages, surrounding conversation, severity, repetition, and prior moderation history. Responses may include a reminder, warning, chat timeout, or suspension; serious violations can warrant immediate action. These guidelines are also available in the game under Settings → Chat → Chat guidelines.

Fractara is a location-based game, but sharing your location is your choice. You can play without it, decline when the Game asks, and revoke permission at any time in your device or browser settings. With your permission, the Game uses your device's precise location for GPS relocation and nearby gameplay, along with occasional foreground travel checks described in our Privacy Policy. GPS relocation itself requires location permission and follows the Game's normal travel rules.

You are responsible for your own safety when playing. Always be aware of your surroundings, obey local laws, and do not trespass on private property or enter dangerous areas while playing. We are not responsible for any injuries, damages, or legal issues that may arise from playing in specific locations.

Old World Coins are Fractara's premium in-game currency. When purchases are available, you can buy them with real money in the Game's store: in the iOS app through Apple's App Store, in the Android app through Google Play, and, where we offer it, on the web through our payment provider. You can also obtain them in the Game, for example by trading with other players or through rewards we offer. Old World Coins can be spent on in-game offers such as Wardrobe items, hot slots, Gold Purse upgrades, pet training, and scrolls.

Old World Coins and every other virtual item, including gold and items bought with coins, are licensed to you, not sold. We grant you a limited, personal, revocable license to use them within the Game. They are not your property, have no real-world cash value, and cannot be exchanged, cashed out, or redeemed for money or anything else of value outside the Game. Unless applicable law requires otherwise, we do not refund or compensate you for virtual currency or items that are spent, traded, lost, or removed.

The Game is in active development. We may change prices, coin packs, offers, what Old World Coins can buy, and how items work, and we may discontinue any of them. If the Game shuts down, Old World Coins and virtual items can no longer be used. We will give reasonable notice in the Game before shutting it down and will stop selling Old World Coins before then.

If you are under 18, or under the age of majority where you live, you must have a parent or guardian's permission before making any purchase. Purchases made through Apple's App Store or Google Play are also subject to Apple's or Google's terms and payment policies.

All purchases are final once the Old World Coins are delivered to your character, except where applicable law or the store's refund policy requires otherwise. Request a refund for an App Store or Google Play purchase from Apple or Google, which handle those payments. For other purchase questions, see our support page.

If a purchase is refunded, reversed, or charged back, we may remove up to the number of Old World Coins it added from any character on your account. If those coins have already been spent or traded, we may place Old World Coin spending and transfers on your account on hold until the matter is resolved; other gameplay remains available. If a refund or chargeback is later reversed in your favor, we restore the coins we removed. Fraudulent purchases or abuse of refunds and chargebacks may also lead to action under the Termination section.

Old World Coins and many items, including Wardrobe items, can be traded with other players using the Game's own trading features. Trades are between players and at your own risk. We do not guarantee the value of anything you trade and are not required to reverse a completed trade. Trading for real money or anything else of value outside the Game is not allowed, as described under Acceptable Use, and may lead to removal of the coins or items involved and suspension of the accounts involved.

All content in Fractara, including but not limited to graphics, artwork, text, game mechanics, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Game without our express written permission.

Any content you create or submit in the Game (such as chat messages or custom names) remains your responsibility. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the Game. We reserve the right to remove any content that violates these terms.

Players can report messages and block other players from the chat interface. We may review reported content and surrounding context, restrict communication, remove content, or suspend accounts to protect the community and enforce these terms.

You can permanently delete your account from Settings inside the Game, or request deletion without opening the Game by following the instructions on our account deletion support page. Deletion removes your sign-in and personal identifiers, revokes account access, and permanently deactivates your characters. We may retain anonymized or de-identified gameplay, safety, and transaction records for service integrity, financial reconciliation, fraud prevention, safety enforcement, or legal compliance. Chat messages you posted stay in their conversations. Both are described in our Privacy Policy.

Old World Coins and items on deleted characters are lost and are not refunded, unless applicable law requires otherwise.

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these terms. Upon termination, your right to use the Game will immediately cease, and we may delete your account and associated data. Old World Coins and virtual items on a terminated account are forfeited without refund, unless applicable law requires otherwise. If we terminate your account for reasons other than your breach of these terms, we will handle unused purchased Old World Coins as applicable law requires.

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE GAME IS AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE GAME, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY.

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Game shall be resolved through binding arbitration.
